Duivo Terms of Use

1. Apple licence and the role of these terms

Your licence to the iOS app is governed by Apple's Standard Licensed Application End User License Agreement (EULA). These Duivo terms explain the service and subscriptions and supplement that licence; they are not a replacement custom EULA. Apple's applicable purchase and usage rules also govern transactions made through the App Store.

If these terms conflict with the Standard EULA on app-licensing matters, the Standard EULA controls. Mandatory consumer law always remains applicable. The Privacy Policy explains data processing; accepting terms is not consent to optional tracking.

2. Eligibility and compatible devices

You must have legal capacity to agree to the relevant service or have the authorization of a parent or guardian where required. An App Store content age rating does not itself authorize a child to make purchases or consent to tracking. Use your own authorized Apple Account for purchases and protect access to your device.

Duivo is designed for iPhone. Current iOS/device requirements are shown in the App Store. Camera combinations, lenses, resolution, frame rate, encoding and performance depend on the device, operating system and selected mode. Simultaneous front-and-back capture requires compatible hardware. A Pro subscription cannot add unsupported hardware capabilities. Website illustrations are demonstrations, not a promise that every iPhone offers every setting.

3. Free features and Duivo Pro

The current free features include photo/video capture and reviewing or deleting captures in the local library. Pro includes export to Apple Photos, automatic saving to Photos when enabled, teleprompter tools and additional video/format, timer and grid controls supported by the device. The purchase screen explains the included features before you buy.

A subscription buys access to the stated Pro features for its paid period, not cloud storage, permanent access or future hardware support. Camera/microphone/Photos permissions, available storage and a functioning device are still required for relevant operations. An internet connection may be needed for purchase, restoration and entitlement verification.

4. Plans, prices and offers

Duivo may offer weekly, annual and promotional annual subscription products. Available products and prices can vary by storefront and offer eligibility. The price, currency, billing period and any applicable offer shown in the app and confirmed by Apple's purchase sheet apply to that transaction. Check the total charged for the billing period before confirming.

An annual price displayed as a weekly equivalent is a comparison only; the annual amount is paid upfront, not in weekly instalments. A savings percentage identifies the comparison presented on that offer screen; it is not necessarily a reduction from a previously charged price. A promotional annual product is a subscription, not a lifetime purchase. A free trial or introductory price applies only when explicitly offered and confirmed by Apple, with its eligibility and renewal terms.

Plan changes, any prorating, offer eligibility and renewal-price changes are administered under Apple's applicable rules and any legally required notices or approvals. We cannot promise that a past offer will remain available indefinitely.

5. Billing and automatic renewal

Payment is processed through your Apple Account upon confirmation. Subscriptions automatically renew unless cancelled before the renewal deadline applicable to your purchase. To avoid an unwanted renewal, cancel at least 24 hours before the current period ends; Apple may process the renewal charge within the 24 hours preceding that end. The Apple subscription screen shows the renewal date and price for your subscription.

If an offer includes a trial, follow the trial's stated cancellation deadline to avoid a charge. Charges and applicable taxes are handled through Apple's purchase flow. Duivo does not collect your payment card details or independently charge your card.

6. Cancellation, restoration and refunds

Manage or cancel in iPhone Settings → your Apple Account → Subscriptions, or use Apple's subscription management page. Cancellation generally stops the next renewal while access continues until the end date Apple shows; special trial rules, refunds or revoked transactions may affect that date. Cancelling an unfinished purchase sheet does not cancel an already active subscription.

Deleting Duivo, changing devices, disabling tracking or requesting data deletion does not cancel billing. After reinstalling, use Duivo → Settings → Restore Purchases with the Apple Account that purchased Pro. A pending or unverified transaction may need to be resolved before access can be granted. Contact us if Apple shows an active subscription but restoration fails.

For a purchase charged by Apple, start a refund request at reportaproblem.apple.com. Eligibility and handling depend on the transaction, storefront and applicable law; approval is not guaranteed. You can also contact us about a service defect or any statutory remedy. These terms do not impose a blanket “no refunds” rule or remove cancellation, withdrawal, conformity, repair, replacement, price-reduction or refund rights available under mandatory law. Any lawful exception to a digital-content withdrawal right depends on the applicable law and purchase process; visiting this page alone does not waive it.

7. When Pro ends

When Pro expires or Apple revokes access, Pro features become unavailable after the entitlement change is recognized. The app returns to its free features. Existing local captures are not intentionally deleted because Pro ended; you can continue to review or delete them, but export to Photos requires active Pro. A capture already in progress is not deliberately interrupted solely because the Pro status changes; later captures use the available free controls.

To keep copies outside Duivo, export while you have access and verify that the files were saved successfully. Refunds and revocations may end Pro earlier than the original renewal date.

8. Your recordings and responsible use

You retain the rights you hold in your recordings and teleprompter text. Duivo does not acquire ownership of them or a licence to publish them, use them in advertising or train AI models. Local camera processing does not upload them to us. If you send a support attachment, we may process it only as needed for the support request and related lawful obligations, as explained in the Privacy Policy.

You are responsible for having the legal right to record and use the people, voices, music and other material you capture, including any notice or consent the law requires. Do not use Duivo for unlawful surveillance, harassment, non-consensual intimate recording, intellectual-property infringement or other unlawful activity. Do not interfere with service security or bypass payment controls. These provisions do not restrict activities that applicable law expressly permits, including protected interoperability or security-research rights.

Duivo's software, name, branding and site materials remain protected by their respective owners' rights. Recording permission does not give you rights in someone else's content; conversely, these terms do not claim rights in your lawful original work.

9. Local storage, export and backup

Duivo is not a cloud backup service. Recordings and scripts are held on your device and can be lost through deletion, device failure, lack of storage or uninstalling the app. Exported Photos copies and personal backups are separate from Duivo's library. Deleting one does not necessarily delete the others.

Check the local library after recording, confirm exports and keep appropriate copies of important material. We cannot recover a device-only file we have never received. These practical limitations do not exclude liability or remedies that the law gives you for a defect in the app.

10. Performance, updates and service changes

Camera operation may be affected by temperature, battery, storage, interruptions, other camera sessions or operating-system restrictions. The app may reduce available settings or stop a recording to respect device limits. No particular frame rate, resolution or uninterrupted recording duration is guaranteed on every configuration. Test the intended setup before relying on it for an important recording.

We may provide fixes and updates and change features as the product evolves. We will not use a general change clause to remove mandatory rights concerning paid functionality, necessary updates or an existing subscription. If a material change or discontinuation affects paid access, we will provide information and any remedy required by law, including applicable cancellation or refund routes. A device's inability to support a new feature is not a promise to add that capability.

11. Third-party services and responsibility

Apple operates App Store distribution and payment services; RevenueCat assists with subscription verification. Optional measurement and other provider roles are explained in the Privacy Policy. External services are subject to their applicable terms, but their involvement does not remove our own legal responsibilities to you.

We do not guarantee that software will always be error-free or that every third-party service will always be available. Our responsibility is determined by the applicable Standard EULA, these supplementary terms and mandatory law. Nothing here excludes or limits liability that cannot lawfully be excluded or limited, including applicable liability for fraud, deliberate misconduct, gross negligence, death/personal injury or mandatory consumer and data-protection rights.

12. Ending use and addressing misuse

You can stop using Duivo at any time. Before deleting the app, preserve desired recordings and cancel any unwanted subscription separately. App-licence termination is governed by the Standard EULA. Any restrictions needed to address misuse must be proportionate and consistent with applicable law; they do not authorize destruction of your local recordings or forfeiture of statutory consumer remedies.

13. Consumer rights, complaints and disputes

If something is wrong, email [email protected] with a brief description and relevant app/transaction information. We may ask for enough information to investigate; do not send passwords or full card numbers. Contacting support is not a mandatory barrier to a regulator, court, Apple refund request or other remedy available by law.

Applicable law and jurisdiction are determined by mandatory legal rules and the Standard EULA where relevant. These supplementary terms do not impose a new exclusive foreign court, compulsory arbitration or class-action waiver. Consumers retain protections and competent forums available in their country. In Türkiye, relevant consumer arbitration committees and consumer courts remain available within their statutory competence; applicable preliminary procedures remain in force.

14. Changes, interpretation and contact

The date above identifies this version. Material changes will be notified as required by law. A later change does not retroactively alter a completed purchase or waive an accrued statutory right; where express acceptance is legally necessary, continued use alone is insufficient.

If a provision is unenforceable, the remaining provisions apply to the extent permitted by law. Failure to enforce a provision immediately is not a general waiver. English and Turkish versions are provided for accessibility; neither overrides mandatory local rights.
